| Legal basis: | + Law No. 52/2005 / QH11 dated 29/11/2005 of the National Assembly on Environmental Protection. + Decree No. 29/2011 / ND-CP dated 18/4/2011 of the Government on strategic environmental assessment, environmental impact assessment, environmental protection commitments. + Circular No. 26/2011 / TT-BTNMT 18/7/2011 detailing a number of articles of Decree No.29 / 2011 / ND-CP dated 18/4/2011 of the Government on SEA, environmental impact assessment, environmental protection commitments. + Decision No. 27/2013 / QD-PPC dated 07.24.2013 of Long An province enacting regulations on the order and procedures for the receipt and management of investment projects outside industrial parks in Long An. + Decision No. 30/2013 / QD-dated 07/30/2013 of the provincial People's Committee of Long An on amendment and supplement of charges, fees and percentage (%) retained from the collection of fees in Long An province. |
| Implementing process: | + Step 1: Prepare sufficient document as set out in components and number of document sets (prepared by land users) Applications shall be submitted to Files Receiving and Results Returning Division of Long An Department of Natural Resources and Environment (Address: No. 137, NR 1, ward 4, Tan An City, Long An province; Tel: 072 3524111). + Step 2: Receiving and processing files. - Receiving files: the officials check the legality of files. . Where records are complete, valid, write a receipt and give to the applicant, transfer the file to the handling department; . For insufficient files, or invalid files, the dossier-receiving officials provide instructions to the applicant to timely rework. - Files handling: By Office of Registration of land use rights under the Department of Natural Resources and Environment. + Step 3: Returning certificates at Files Receiving and Results Returning Division: . Recipients of file results shall return the receipt to the officials for them to return the results. . Civil servants return the results of checking the bills that are done with financial liabilities and instruct the recipients to pay fees, charges for certification at financial division of Land use registration office of the Department of Natural Resources and Environment; . Civil servants return checking results of fee paying bills and request the recipients to sign in the file handling book. Note: Recipients must show their identity card or passport. In case the recipients are not the legal representatives, they must have a referral or authorization letter. |
| Application components: | + One (01) written document of the owner requsting for evaluation and approval of reports on environmental impact assessment done in the form prescribed in Appendix 2.3 Circular No. 26/2011 / TT-BTNMT 18 / 7/2011 of the Ministry of Natural Resources and Environment detailing some articles of Decree No.29 / 2011 / ND-CP dated 18/4/2011 of the Government on strategic environmental assessment, evaluation environmental impact, commitment to environmental protection. + Seven (07) reports on environmental impact assessment of the project. Where the number of members of evaluation council is more than seven (07) persons, or where necessary in accordance with the requirements of the evaluation, the project owner must provide additional number of reports on environmental impact assessment. Form of cover, cover page; structure and requirements for the contents of the report on environmental impact assessment done in the form prescribed in Appendix 2.4 and 2.5 Circular No. 26/2011 / TT-BTNMT dated 18/7/2011 of the Ministry of Natural Resources and environment detailing some articles of Decree No.29 / 2011 / ND-CP dated 18/4/2011 of the Government on strategic environmental assessment, environmental impact assessment, orange to protect the environment. + One (01) investment project document (feasibility study report). + For projects renovating, expanding, upgrading and increasing the capacity of the production facility, sales and service operations approved environmental impact assessment report or registered, verified the environmental protection commitment registration or certification environmental standards or approval and certification schemes for environmental protection must be accompanied by one (01) copy of the decision approving the EIAR or certificate of registration of environmental standards, the decision to approve or certification schemes for environmental protection or documents evidencing commitment to protect the environment being registered of the manufacturing facility, operating services. + For Projects whose EIAR has been approved but not come into operation, one (01) copy of decision approving EIAR of the previous project should be submitted. |
